Timeless Terms of Use

Welcome to Timeless. Please read this agreement carefully before using the app. It is a legal agreement between you and the developer of Timeless.

1. Service Description

Timeless is an iOS app for organizing personal collections, made by an independent developer ("we", "us"). These terms are the end user license agreement for the app and the website at timelesscollections.net. Apple is not a party to them, and we, not Apple, are solely responsible for Timeless and its content.

These terms apply to Timeless as offered on the App Store outside China mainland. If you downloaded the app from the China mainland App Store, the Chinese 用户协议 applies instead.

By downloading or using Timeless, you accept these terms. If you do not accept them, do not use the app. How we handle data is described in our Privacy Policy, which forms part of these terms.

You must be at least 13 years old to use Timeless. If you are under the age of majority where you live, you may use it only with a parent or guardian who accepts these terms on your behalf.

2. Your License

2.1 What You May Do

We grant you a personal, non-transferable, non-exclusive, revocable license to use Timeless on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, and through Family Sharing or volume purchasing where those are available.

2.2 What You May Not Do

You may not:

• copy, sell, rent, sublicense, or redistribute the app;
• reverse engineer, decompile, or disassemble the app, except where applicable law expressly permits it;
• remove or obscure any copyright, trademark, or other proprietary notice;
• access our server API by any means other than the app, use automated tools against it, or circumvent its rate limits;
• use the app for any unlawful purpose or in violation of these terms.

3. Usage Rules

You may not use Timeless or its assistant to:

• submit or generate content that is unlawful, infringing, defamatory, harassing, or hateful, that sexualizes minors, or that promotes violence;
• submit images or material that you have no right to submit, or that contain other people's personal information without their consent;
• seek instructions for illegal activity or for causing serious harm;
• defeat the safety measures of the assistant or its model providers, or extract their underlying prompts or models;
• build a competing service, benchmark the underlying models, or use the output to train another AI model.

If you receive output you consider objectionable, report it to [email protected]. We may suspend or terminate your access to server-side features, including the assistant, if you breach these terms or if it is necessary to protect the service. Your local data is not affected.

4. The AI Assistant

4.1 Accuracy

AI output can be inaccurate, incomplete, outdated, or entirely invented. Facts, figures, identifications, and dates produced by the assistant are suggestions, not verified information. Check anything that matters before relying on it.

4.2 Changes to Your Data

The assistant never changes your collections by itself. It proposes changes, and the app applies them only after you accept. You are responsible for the result of accepting, including changes that turn out to be wrong or that delete something. Review proposed changes before accepting them, especially deletions.

4.3 Not an Appraisal or Professional Advice

Timeless records values that you enter, and the assistant may discuss what an item is or what it might be worth. None of this is an appraisal, a valuation, an authentication, a grading, an insurance document, or investment, tax, or legal advice. Do not rely on it as a basis for insuring, buying, or selling an item.

4.4 Availability

The assistant requires an internet connection and an active subscription, and is subject to fair-use rate limits. We may adjust those limits, change or replace the underlying models, or suspend the feature for maintenance or a provider outage.

5. Your Content and Backups

Everything you put into Timeless remains yours. We claim no ownership of your collections, item details, or photos, and we take no license to them beyond what is needed to deliver a feature you asked for. You are responsible for having the right to store and submit your content.

Backups are your responsibility. Your data is stored on your device and, with iCloud enabled, in the private database of your own iCloud account. iCloud is an Apple service, subject to Apple's terms and your storage limits. We hold no copy of your data and cannot recover it if it is lost, whether through device loss, deleting the app, disabling iCloud, an Apple service failure, or a change you accept in the app. Keep independent backups of anything you cannot afford to lose.

6. Subscribe to Timeless

Timeless is free to download. Without a subscription you can create up to 50 items in total across all of your collections, and the AI assistant is not available.

• Subscription plan: Timeless Premium, offered as Premium Monthly and Premium Annual.
• Subscription type: auto-renewable subscription, purchased inside the app. The monthly plan bills every month and the annual plan bills every twelve months. Both unlock the same features.
• What it unlocks: the 50-item limit is removed and the AI assistant becomes available.
• Subscription price: the price of each plan is shown in the app before you buy, and is charged to your Apple Account at confirmation of purchase. Where the app shows a monthly figure next to the annual price, it is the annual price divided by twelve, shown for comparison only; the annual plan is billed once per year as a single payment.
• Free trial: new subscribers are offered a 7-day free trial. The app shows before you buy whether the plan you selected includes it. When the trial ends it becomes a paid subscription at the price of the plan you chose, unless you cancel at least 24 hours before that. Apple grants the trial once per subscription group, so it is not available if you have used it before on either plan.
• Renewal: the subscription renews automatically at the same price at the end of each billing period — every month on the monthly plan, every twelve months on the annual plan — unless you cancel at least 24 hours before the current period ends. Your Apple Account is charged within 24 hours before the end of that period.
• Switching plans: you can move between the monthly and annual plans in iPhone Settings → Apple Account → Subscriptions. Apple decides when the change takes effect and calculates any credit or charge for it.
• Cancel subscription: go to iPhone Settings → Apple Account → Subscriptions and cancel Timeless Premium, or use the settings screen in the app. Cancelling stops the next renewal; the subscription stays active until the end of the period you already paid for, and Apple does not refund the unused part of that period. Deleting the app does not cancel the subscription.
• Refunds: Apple is the merchant of record and handles all payments, taxes, and refunds. We cannot issue refunds ourselves. Request one at reportaproblem.apple.com.

We may change the price or contents of the subscription for future billing periods.

If your subscription ends, the app keeps working in its free form. Nothing you created while subscribed is deleted or hidden, and you can still open, edit, and delete all of it. What stops is the AI assistant, and adding new items while your total is at or above 50.

7. Intellectual Property

We own all rights to Timeless, including its software, name, design, icon, and content, other than your own content and third-party components. Reproduction, modification, or distribution of any of it without permission is prohibited. Fonts and other third-party software in the app remain the property of their authors and are used under their own licenses, which are included with the app.

8. Disclaimer and Limitation of Liability

To the maximum extent permitted by law, Timeless is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted or error-free, that the assistant's output will be accurate, or that data will never be lost or corrupted.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost collections, lost or corrupted data, or the cost of substitute services. Our total liability for all claims is limited to the greater of what you paid us in the twelve months before the claim, or twenty US dollars. You agree to hold us harmless from any claim or expense arising from your misuse of Timeless, your breach of these terms, or your violation of a third party's rights.

Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you. Nothing in these terms limits a right you have under consumer law that cannot be waived.

9. Apple and Other Third Parties

These terms are between you and us only. Nothing in them conflicts with the Apple Media Services Terms and Conditions; if anything did, those terms prevail as between you and Apple. The following applies as Apple requires:

• We, not Apple, are solely responsible for providing maintenance and support for Timeless. Apple has no obligation to furnish any maintenance or support services for it.
• We, not Apple, are solely responsible for any product warranties that section 8 does not effectively disclaim. If Timeless fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Timeless, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
• We, not Apple, are responsible for addressing any claim of yours or of a third party relating to Timeless or your possession and use of it, including product liability claims, any claim that Timeless fails to conform to a legal or regulatory requirement, and claims arising under consumer protection legislation.
• We, not Apple, are responsible for the investigation, defense, settlement, and discharge of any third-party claim that Timeless or your use of it infringes that party's intellectual property rights.
• You represent that you are not located in a country subject to a US government embargo or designated by the US government as a terrorist-supporting country, and that you are not listed on any US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, have the right to enforce them against you.

Timeless also relies on services operated by others, including Apple's App Store, iCloud, and CloudKit, our hosting provider, our analytics provider, and the AI model providers named in the Privacy Policy. You must comply with the applicable third-party terms when using Timeless, and we are not responsible for the acts or omissions of those third parties.

10. Changes and Contact

We may add, change, or remove features, and we may modify these terms at any time. The new version is posted at this address with a new effective date, and for a material change we will show a notice in the app or on the website before it takes effect. Continuing to use Timeless means you accept the new terms.
